1. Introduction

Welcome to TrackLenma.

These Terms and Conditions ("Terms") govern your access to and use of TrackLenma's website, mobile application, web dashboard, GPS tracking devices, and related services (collectively referred to as the "Services").

By creating an account, purchasing a TrackLenma device, subscribing to our Services, or otherwise using our platform, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use our Services.

2. About TrackLenma

TrackLenma is a GPS fleet tracking and telematics company registered in The Gambia.

Our platform provides GPS tracking and fleet management services for businesses and individuals, including but not limited to:

• Real-time vehicle tracking
• Fleet management
• Route history
• Geofencing
• Speed monitoring
• Vehicle reports
• Alerts and notifications
• Driver management
• Vehicle management
• Organization management
• Mobile and web access

TrackLenma currently operates in The Gambia and may expand its services to other African countries in the future.

3. Definitions

For the purposes of these Terms:

• Account means a registered user profile used to access the Services.
• Customer means any individual or business using TrackLenma's Services.
• Device means a GPS tracking unit supplied or supported by TrackLenma.
• Organization means a company or entity managing one or more vehicles through the platform.
• Manager means an authorized representative of an organization with administrative permissions.
• User means any person authorized to access an Account.
• Subscription means a paid service plan that enables access to TrackLenma Services.
• Vehicle means any car, truck, motorcycle, bus, heavy equipment, or other asset connected to the Services.

4. Eligibility

To use the Services you must:

• Be at least 18 years old or the legal age required in your country.
• Have the legal authority to enter into a binding agreement.
• Provide accurate registration information.
• Maintain accurate account information.

Businesses registering an organization confirm that they are authorized to act on behalf of that Organization.

5. User Accounts

You are responsible for maintaining the confidentiality of your login credentials.

You agree to:

• Keep your password secure.
• Notify TrackLenma immediately of any unauthorized access.
• Ensure that information in your account remains accurate.
• Accept responsibility for activities carried out under your account.

TrackLenma may suspend or terminate accounts that contain false information or are used fraudulently.

6. Services

TrackLenma provides software and hardware solutions for vehicle tracking and fleet management.

Services may include:

• Live GPS tracking
• Vehicle location history
• Geofence creation and alerts
• Speed monitoring
• Trip reports
• Driver and organization management
• Notifications by email, SMS, or mobile application
• Device management
• Reporting and analytics

Certain features may only be available under selected subscription plans.

7. Subscription Plans

Access to some Services requires an active subscription.

Subscription plans may be offered on a monthly, quarterly, annual, or other billing cycle.

Failure to renew a subscription may result in suspension or termination of certain Services until payment is received.

TrackLenma reserves the right to change subscription plans or pricing after providing reasonable notice.

8. Payments

Customers agree to pay all applicable fees associated with their subscription.

Payments may include:

• Device purchase
• Installation fees
• Subscription fees
• Taxes where applicable

Late or failed payments may result in suspension of Services.

Unless required by law, payments are non-refundable.

9. GPS Devices

TrackLenma is responsible for ensuring that customers' GPS devices are installed correctly.

Customers must not:

• Modify devices without authorization.
• Tamper with device hardware after installation.
• Attempt to bypass device security.
• Use devices for unlawful purposes.

Misuse of GPS Devices may void the product warranty.

10. Acceptable Use

Customers agree to use the Services lawfully.

You must not:

• Use the Services to commit criminal offences.
• Attempt unauthorized access to the platform.
• Reverse engineer the software.
• Distribute malware.
• Interfere with platform security.
• Share accounts without authorization.
• Track individuals without lawful authority or consent where required by applicable law.
• Attempt to swap GPS devices to any other vehicle after being installed on the registered vehicle.

TrackLenma reserves the right to suspend accounts involved in any prohibited activities.

11. Location Data

The Services collect location information from registered GPS devices.

Customers acknowledge that:

• Vehicle location data is necessary to provide the Services.
• Historical location records may be stored.
• Alerts and reports are generated using collected data.
• Customers are responsible for ensuring they have any permissions or consents required to track vehicles or drivers.

12. Privacy

TrackLenma processes personal information in accordance with its Privacy Policy.

By using the Services, you acknowledge that your information may be collected, stored, and processed as described in that policy.

13. Service Availability

TrackLenma aims to provide reliable Services but cannot guarantee uninterrupted operation.

Service interruptions may occur due to:

• Scheduled maintenance
• Emergency maintenance
• Mobile network failures
• Internet outages
• GPS satellite availability
• Power failures
• Events beyond TrackLenma's reasonable control

TrackLenma is not responsible for downtime caused by third-party service providers.

14. Mobile Networks

TrackLenma relies on third-party mobile network operators for device connectivity.

Customers understand that:

• Coverage depends on the selected GSM operator.
• Roaming availability depends on agreements between mobile operators.
• Network outages may affect tracking accuracy or availability.
• Data transmission may be delayed during periods of poor coverage.

TrackLenma is not responsible for interruptions caused by telecommunications providers.

15. Customer Responsibilities

Customers agree to:

• Keep subscription payments up to date.
• Ensure devices remain powered.
• Protect account credentials.
• Keep contact information current.
• Report lost or stolen devices promptly.
• Take full responsibility for the TrackLenma GPS device after installation. If the device is lost, stolen, damaged, or destroyed (including by fire), the customer must pay for its replacement including payment of the subscription package. This obligation remains even if the customer's vehicle is stolen. Failure to pay for the device may result in legal action.
• Use the Services responsibly.

16. Intellectual Property

All intellectual property relating to TrackLenma, including software, GPS device and its components, SIM cards, logos, trademarks, website content, social media handles, mobile applications, documentation, graphics, and source code, remains the exclusive and full property of TrackLenma or its licensors.

Customers receive a limited, non-transferable license to use the Services during an active subscription.

17. Limitation of Liability

To the maximum extent permitted by law, TrackLenma shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of the Services.

This includes, but is not limited to:

• Vehicle theft
• Accidents
• Loss of profits
• Loss of business
• Delayed GPS updates
• GPS inaccuracies
• Mobile network failures
• Satellite failures
• Internet outages
• Force majeure events

Customers acknowledge that the Services are intended to assist with vehicle monitoring and do not guarantee the prevention of theft, accidents, or other losses.

18. Suspension and Termination

TrackLenma may suspend or terminate an account where:

• Subscription fees remain unpaid.
• Fraud is suspected.
• The Services are used unlawfully.
• These Terms are materially breached.
• Continued use presents a security risk.

Customers may terminate their account by contacting TrackLenma, subject to any outstanding contractual obligations.

19. Disclosure Required by Law

TrackLenma respects the privacy of its customers and does not disclose personal information or vehicle location data except where necessary to provide our Services or as permitted by these Terms and our Privacy Policy.

However, TrackLenma may disclose customer information where required to do so by applicable law, a valid court order, or a lawful request from a government authority, law enforcement agency, or regulatory body with the legal authority to request such information.

Where legally permitted, TrackLenma may notify the affected customer before disclosing the requested information. If notification is prohibited by law or would interfere with an investigation, TrackLenma may provide the information without prior notice.

TrackLenma will disclose only the information reasonably necessary to comply with the applicable legal obligation or lawful request.

20. Changes to Services

TrackLenma may improve or modify the Services.

TrackLenma may modify, improve, suspend, or discontinue any part of the Services at any time.

Where practical, customers will receive reasonable notice of significant changes.

21. Changes to these Terms

TrackLenma may update these Terms from time to time.

Updated versions will be published on the TrackLenma website and become effective on the stated effective date.

Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

22. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of The Gambia.

Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts of The Gambia, unless otherwise required by applicable law.

23. Entire Agreement

These Terms, together with the Privacy Policy, Subscription & Billing Policy, Device Warranty & Returns Policy, and any other policies published by TrackLenma, constitute the entire agreement between TrackLenma and its customers regarding the use of the Services.
